This Disclaimer explains the nature and limitations of YOU™ registration, Certificates, verification records, review procedures, cryptographic evidence, Qualified Electronic Timestamps, QR and NFC services, provenance records and related professional-support services.

Nothing in this Disclaimer excludes or limits rights, remedies or liabilities that cannot lawfully be excluded or limited under applicable law.

YOU™ is an independent private registration, documentation and verification service for unique artistic, handmade and collectible Works.

YOU™ is not:

  • a government copyright office;
  • a trademark office;
  • a patent office;
  • a design-right registry;
  • a court;
  • a government title registry;
  • an intellectual-property authority;
  • an official EU Digital Product Passport Registry;
  • or another governmental registration body.

A YOU™ Registration Record is therefore not a government-issued intellectual-property registration.

A YOU™ Registration Record may document information including:

  • the identity of a specific Work;
  • the declared Creator;
  • selected photographs and video;
  • materials;
  • dimensions;
  • description;
  • declared creation information;
  • submitted supporting evidence;
  • review status;
  • Registration ID;
  • Registration Manifest;
  • cryptographic hashes;
  • qualified timestamp information;
  • Certificate status;
  • Verification Page information;
  • QR or NFC information;
  • ownership events;
  • provenance events; and
  • audit-history events.

The record documents information submitted, processed and maintained through YOU™.

It does not automatically transform every submitted statement into an independently established legal fact.

A YOU™ Registration Record, Certificate, Qualified Electronic Timestamp or provenance record may form part of an evidentiary package.

Its evidentiary value may depend on factors including:

  • the information submitted;
  • supporting documents;
  • the integrity of the registration process;
  • timestamp evidence;
  • subsequent events;
  • applicable law;
  • the forum considering the evidence;
  • and other evidence presented by the parties.

YOU™ does not determine the legal outcome of a dispute.

A court, administrative authority, marketplace, payment provider, insurer, auction house or other third party remains free to assess evidence according to its own legal duties, procedures and evidentiary rules.

YOU™ registration should not be confused with formal intellectual-property registration.

For example:

  • copyright may protect qualifying original expression;
  • trademark law generally protects signs identifying commercial origin;
  • registered design systems may protect qualifying product appearance;
  • patents concern qualifying inventions;
  • ownership of a physical object concerns the object itself.

These rights are legally distinct.

Ownership of the physical Work does not necessarily mean ownership of copyright.

Similarly, copyright ownership does not necessarily mean ownership of the physical object.

YOU™ registration does not merge or replace these different legal rights.

Where a creator or business requires:

  • copyright registration;
  • trademark registration;
  • registered-design protection;
  • patent protection;
  • customs recordation;
  • court relief;
  • or another official legal procedure,

YOU™ does not replace that procedure.

A YOU™ record may be useful as additional evidence concerning a Work and its documented chronology, but users should choose official procedures appropriate to their particular legal objective where applicable.

YOU™ records the Creator attribution contained in the approved Registration Record.

YOU™ does not independently guarantee that the person identified as Creator is legally recognised as the author under every applicable law.

Creator attribution may be based on:

  • applicant declarations;
  • submitted evidence;
  • review results;
  • registration history; and
  • other available information.

The Review Process is not equivalent to a judicial determination of authorship.

A YOU™ Registration Record does not automatically establish copyright ownership.

Copyright ownership may depend on circumstances including:

  • authorship;
  • employment relationships;
  • commissioned-work arrangements;
  • assignments;
  • licences;
  • collaboration agreements;
  • inheritance;
  • national law;
  • and other legal facts.

YOU™ does not independently determine every possible contractual or legal transfer of intellectual-property rights.

YOU™ does not conduct an exhaustive worldwide search of:

  • existing artworks;
  • handmade works;
  • catalogues;
  • private collections;
  • social networks;
  • copyright databases;
  • trademark databases;
  • design registries;
  • historical archives;
  • or every other potentially relevant source.

Approval therefore does not guarantee that no similar, related or earlier Work exists.

YOU™ also does not determine whether a Work satisfies every legal threshold for copyright, design or other intellectual-property protection in every jurisdiction.

Registration does not prevent another person from asserting:

  • authorship;
  • copyright;
  • ownership;
  • trademark rights;
  • design rights;
  • contractual rights;
  • privacy rights;
  • publicity rights;
  • or another legal interest.

The existence of a competing claim does not by itself establish that the YOU™ Registration Record is incorrect.

Similarly, the existence of a YOU™ Registration Record does not automatically defeat a competing claim.

Disputes must be evaluated on their evidence and applicable law.

YOU™ does not guarantee that a Registration Record or Certificate will result in:

  • success in court;
  • dismissal of a claim;
  • success in arbitration;
  • removal of infringing content;
  • restoration of a marketplace listing;
  • enforcement by a platform;
  • recovery of damages;
  • recognition by customs;
  • a successful insurance claim;
  • or another particular legal or commercial result.

Courts, platforms and other organisations apply their own rules and may require additional evidence.

YOU™ may conduct a Review Process before approving a registration.

Review may consider matters including:

  • completeness;
  • consistency;
  • correspondence between information and submitted evidence;
  • visible identifying characteristics;
  • apparent anomalies;
  • duplicate registrations;
  • compliance with registration rules;
  • and other factors relevant to the integrity of the Registry.

Review does not constitute a guarantee of authenticity or legal ownership.

The YOU™ Review Process does not ordinarily include:

  • a worldwide prior-rights search;
  • a comprehensive copyright clearance search;
  • forensic laboratory testing;
  • scientific material authentication;
  • radiocarbon or chemical dating;
  • handwriting authentication;
  • forensic image analysis to evidentiary standards;
  • physical inspection of every Work;
  • professional market appraisal;
  • provenance certification by an auction house;
  • or legal advice concerning a specific dispute.

Unless expressly stated otherwise, the review is based on the information and evidence available to YOU™ through the registration process.

YOU™ may use reasonable procedures to identify suspicious or inconsistent submissions.

However, no review process can guarantee that every:

  • false statement;
  • fabricated document;
  • manipulated image;
  • copied Work;
  • impersonation;
  • undisclosed co-author;
  • false ownership claim;
  • or other fraudulent act

will always be detected.

Users should not treat approval as an absolute guarantee against fraud.

YOU™ may calculate a cryptographic hash from specified electronic data.

A cryptographic hash can help demonstrate whether the relevant digital data has changed.

If the same hashing process applied to the same data produces the expected matching result, this may support a conclusion that the compared digital data is unchanged.

However, a hash does not by itself establish:

  • who created the Work;
  • who owned the data;
  • who uploaded the data;
  • whether the physical Work existed;
  • whether the Work was original;
  • whether copyright subsists;
  • or whether infringement occurred.

A hash is calculated from digital data.

It therefore does not independently prove that:

  • a photographed physical object was present at a particular location;
  • the physical object currently presented is the same object;
  • the object has not been physically modified;
  • the object has not been substituted;
  • or the object’s materials are as described.

Physical identification should be assessed together with the Registration Record, photographs, identifying characteristics, provenance, QR/NFC information and other relevant evidence.

An electronic timestamp may help establish that specified electronic data existed in a particular form no later than a recorded time.

The evidentiary effect depends on the type of timestamp and applicable law.

An ordinary application timestamp or server timestamp is not the same as a Qualified Electronic Timestamp under eIDAS.

Where expressly identified by YOU™ as such, a Qualified Electronic Timestamp is a timestamp meeting the applicable qualification requirements of the eIDAS framework.

Under eIDAS, a Qualified Electronic Timestamp benefits from a legal presumption concerning:

  • the accuracy of the date and time it indicates; and
  • the integrity of the data to which that date and time are bound.

The qualified status of the timestamp does not extend that presumption to unrelated facts.

A Qualified Electronic Timestamp does not by itself prove:

  • legal authorship;
  • copyright ownership;
  • originality;
  • ownership of the physical Work;
  • physical existence of the Work at the timestamped moment;
  • identity of every person involved in creating the Work;
  • absence of earlier similar works;
  • lawful use of all third-party material;
  • or freedom from infringement.

Its legal presumption concerns the timestamped date/time and integrity of the bound data.

Qualified Electronic Timestamp functionality depends on the relevant qualified trust service.

YOU™ will describe a timestamp as qualified only where the relevant service satisfies the applicable qualification requirements.

If qualified timestamping has not been completed, YOU™ will not represent an internal system timestamp as a Qualified Electronic Timestamp.

YOU™ may maintain an integrity-protected history of material registration events.

This may include events relating to:

  • submission;
  • review;
  • approval;
  • hashing;
  • timestamping;
  • Certificate issuance;
  • corrections;
  • ownership changes;
  • disputes;
  • suspension;
  • revocation;
  • and other material actions.

The technical implementation may use cryptographic linking, keyed message authentication, digital signatures or comparable integrity mechanisms.

Where YOU™ describes an audit or activity log as:

  • tamper-evident;
  • integrity-protected;
  • cryptographically linked;
  • or integrity-verifiable,

this means that the system is designed so that unauthorised alteration can be detected under the relevant technical assumptions.

It does not mean that YOU™ claims a database, server or information system is physically or mathematically impossible to attack, compromise, alter or destroy under every conceivable circumstance.

An internal chained log, keyed message authentication mechanism, server signature, digital signature or other YOU™ integrity mechanism is technically and legally distinct from a Qualified Electronic Timestamp.

A valid internal integrity chain may support evidence concerning the sequence and consistency of stored events.

It does not acquire qualified status merely because cryptographic methods are used.

Where an event also has a Qualified Electronic Timestamp, YOU™ will identify that status separately.

YOU™ may display statuses such as:

  • Registered;
  • YOU™ Verified;
  • Registration Verified;
  • Active;
  • Under Review;
  • Disputed;
  • Suspended;
  • Revoked;
  • or another expressly defined status.

Any status must be interpreted according to the definition provided by YOU™.

Where YOU™ uses the status YOU™ Verified or Registration Verified, it means that the Registration Record has completed the applicable YOU™ review and verification procedure and that the Verification Page corresponds to the approved data maintained in the YOU™ system.

This status does not mean that:

  • a government authority has certified the Work;
  • a court has determined authorship;
  • copyright ownership has been legally adjudicated;
  • every statement submitted by the Applicant is independently guaranteed;
  • the physical Work has undergone forensic authentication;
  • or fraud is impossible.

The status confirms the state of the YOU™ Registration Record, not an unlimited legal guarantee concerning the physical Work.

YOU™ should not ordinarily use Verified Authentic as a standalone status without an immediate explanation of its defined meaning.

If the wording Verified Authentic is used in an existing interface or historical record, it means only that:

  1. the relevant Registration Record has successfully completed the applicable YOU™ review procedure;
  2. the digital record matches the approved information stored by YOU™; and
  3. the registration is active or otherwise in the status shown on the Verification Page.

Verified Authentic does not constitute an unconditional guarantee of physical authenticity, legal authorship, copyright ownership, complete provenance or absence of third-party claims.

Where reasonably possible, the preferred public status terminology is:

YOU™ Verified

or

Registration Verified

because those terms more accurately describe what YOU™ has actually verified.

Where a verification status is displayed on:

  • a Verification Page;
  • Certificate;
  • creator dashboard;
  • public Registry;
  • QR result;
  • NFC result;
  • or other customer-facing interface,

YOU™ should make the meaning of that status reasonably accessible.

For example:

YOU™ Verified This registration has completed the YOU™ review and verification process. Verification confirms the status and integrity of the YOU™ record; it is not a government determination of authorship or copyright ownership.

This explanation may be displayed directly, through an information icon, tooltip or linked definition, provided that it is clear and reasonably accessible.

Unless YOU™ expressly provides a separate physical-inspection service, registration may rely substantially on:

  • uploaded photographs;
  • video;
  • submitted documents;
  • technical metadata;
  • declarations;
  • and other remotely supplied information.

Remote review has inherent limitations.

YOU™ cannot inspect qualities that cannot reasonably be determined from the submitted material.

A QR code provides a convenient route to a digital record or verification function.

A QR code does not by itself authenticate the physical object.

QR codes may be:

  • copied;
  • photographed;
  • reproduced;
  • replaced;
  • damaged;
  • or attached to another object.

Users should compare the digital record with the physical Work and its identifying characteristics.

An NFC Passport may create a closer technical link between a tag and a Registration Record.

However, an NFC tag does not make fraud impossible.

Tags may potentially be:

  • damaged;
  • removed;
  • destroyed;
  • transferred;
  • substituted;
  • cloned in some circumstances;
  • or otherwise misused.

Security characteristics depend on the particular NFC technology used.

Where YOU™ uses NFC technology designed to make cloning or unauthorised copying more difficult, this may reduce particular technical risks.

It does not eliminate:

  • physical tag removal;
  • substitution of the physical object;
  • social engineering;
  • theft;
  • account compromise;
  • false sale representations;
  • or every other form of fraud.

Users should verify the Work as a whole rather than relying solely on an NFC response.

YOU™ registration does not guarantee the current physical condition of a Work.

A Work may later be:

  • damaged;
  • repaired;
  • restored;
  • altered;
  • repainted;
  • disassembled;
  • reconstructed;
  • or otherwise changed.

The Verification Page should not be treated as a current condition report unless YOU™ expressly provides such a service.

A YOU™ Ownership Transfer records a transfer represented through the YOU™ system.

It does not automatically replace:

  • a sales contract;
  • invoice;
  • inheritance documentation;
  • customs records;
  • export documentation;
  • tax documentation;
  • or another legally required instrument.

Recording ownership in YOU™ does not constitute a government title-registration system.

A person who owns the physical Work does not automatically own the copyright.

A transfer of the physical Work through YOU™ does not transfer copyright unless the relevant copyright is separately transferred according to applicable law and agreement.

Creator attribution may therefore remain connected to a Work after physical ownership changes.

YOU™ provenance information records events documented within the YOU™ system.

It is not necessarily a complete history of every:

  • owner;
  • sale;
  • exhibition;
  • location;
  • restoration;
  • transfer;
  • or other event

that occurred outside YOU™.

Provenance should therefore be described as recorded provenance rather than an unconditional guarantee of complete historical provenance unless a specific service establishes otherwise.

A marketplace, auction house, gallery, insurer, payment provider or other third party may decide independently whether to accept a YOU™ Certificate or Registration Record.

YOU™ cannot require another organisation to:

  • accept the Certificate;
  • restore a listing;
  • remove another seller;
  • resolve an infringement dispute;
  • insure the Work;
  • purchase the Work;
  • or apply a particular evidentiary weight.

YOU™ registration does not certify general product-law compliance.

A Registration Record does not replace obligations concerning matters such as:

  • product safety;
  • GPSR requirements;
  • toy safety;
  • CE-related requirements;
  • chemical restrictions;
  • labelling;
  • technical documentation;
  • traceability;
  • consumer warnings;
  • or Digital Product Passport obligations.

Responsibility for applicable product compliance remains with the legally responsible economic operator.

YOU™ is not represented as the official EU Digital Product Passport Registry.

A YOU™ Certificate or NFC Passport is not automatically a legally required EU Digital Product Passport.

Where legislation requires a specific Digital Product Passport or connection to an official system, those requirements remain separate unless YOU™ expressly provides a compliant service for that legal framework.

YOU™ does not provide professional appraisal unless a separate appraisal service is expressly offered.

Registration or Certificate issuance should not be interpreted as establishing:

  • market value;
  • replacement value;
  • auction value;
  • insurance value;
  • investment value;
  • or future resale value.

YOU™ does not provide investment advice.

Nothing on YOU™ should be interpreted as a recommendation to:

  • buy;
  • sell;
  • hold;
  • invest in;
  • speculate in;
  • or finance

a particular Work.

A YOU™ Certificate, provenance record or NFC Passport may provide additional documentation concerning a Work.

It does not guarantee:

  • appreciation in value;
  • resale;
  • buyer demand;
  • liquidity;
  • auction acceptance;
  • insurance coverage;
  • or a financial return.

YOU™ may publish educational information concerning:

  • copyright;
  • evidence;
  • trademarks;
  • design rights;
  • product rules;
  • registration;
  • disputes;
  • or other legal topics.

Unless expressly provided through a separate professional legal engagement, such information is general informational material.

It is not personalised legal advice.

  • the duration of proceedings;
  • settlement;
  • enforcement;
  • recovery;
  • or success.

Legal outcomes depend on facts, applicable law, evidence and the relevant authorities or courts.

YOU™ may rely on independent third parties such as:

  • payment processors;
  • hosting providers;
  • qualified trust service providers;
  • cloud providers;
  • NFC manufacturers;
  • shipping providers;
  • email providers;
  • analytics providers;
  • marketplaces;
  • lawyers;
  • accountants;
  • or other professional services.

These parties may operate under their own terms and legal responsibilities.

YOU™ does not guarantee uninterrupted operation of independent third-party systems.

A third-party provider may experience:

  • outages;
  • delays;
  • technical failures;
  • policy changes;
  • security incidents;
  • insolvency;
  • regulatory restrictions;
  • or discontinuation.

Where a third-party failure affects a paid YOU™ service, the consequences are governed by the Terms of Service, No-Refund & Cancellation Policy and mandatory applicable law.

YOU™ may link to websites operated by third parties.

A link does not necessarily mean that YOU™:

  • controls the website;
  • endorses every statement on it;
  • guarantees its availability;
  • accepts responsibility for its content;
  • or assumes responsibility for its privacy or security practices.

Users should review the relevant third party’s own terms and policies.

YOU™ aims to maintain reliable service availability but cannot guarantee uninterrupted operation.

Availability may be affected by:

  • maintenance;
  • infrastructure failures;
  • cyber incidents;
  • provider outages;
  • legal restrictions;
  • internet failures;
  • or other events outside reasonable control.

YOU™ uses security and integrity measures appropriate to the nature of the service.

However, no internet-connected system can guarantee absolute security.

This includes systems involving:

  • user accounts;
  • digital Certificates;
  • databases;
  • hashes;
  • QR codes;
  • NFC tags;
  • public verification;
  • backups;
  • and cryptographic logs.

Users remain responsible for matters within their reasonable control, including:

  • providing materially accurate information;
  • maintaining account security;
  • protecting login credentials;
  • retaining appropriate original evidence;
  • complying with applicable law;
  • preserving the physical Work;
  • and reporting suspected account or NFC compromise.

Where an important transaction or dispute is involved, users should not rely solely on:

  • one photograph;
  • one QR code;
  • one NFC response;
  • one Certificate;
  • one hash;
  • one activity-log entry;
  • or one timestamp.

Evidence should be considered as a whole.

The value of the YOU™ system is intended to arise from the combination of registration data, chronology, supporting material, integrity evidence and other relevant documentation.

Nothing in this Disclaimer removes or restricts mandatory rights available to consumers.

In particular, this Disclaimer does not override any mandatory rights concerning:

  • conformity of services;
  • misleading commercial practices;
  • unfair contract terms;
  • statutory remedies;
  • privacy;
  • withdrawal where legally applicable;
  • or other non-waivable consumer protections.

Nothing in this Disclaimer excludes or limits liability that cannot legally be excluded or limited.

The Terms of Service govern applicable contractual limitations of liability.

This Disclaimer should not be interpreted as granting Unidia any broader exclusion of liability than applicable law permits.

For United States users, this Disclaimer does not permit YOU™ or Unidia to make false or misleading representations concerning the nature, characteristics or benefits of the service.

General disclaimers do not convert an inaccurate or deceptive commercial claim into a lawful one.

YOU™ therefore seeks to describe the evidentiary and technical capabilities of the service accurately and without promising results that the service cannot reasonably provide.

For users protected by EU or EEA consumer law, this Disclaimer must be interpreted consistently with mandatory consumer-protection rules.

A disclaimer cannot remove rights or remedies that applicable EU or national law makes mandatory.

YOU™ also does not use this Disclaimer to represent that an ordinary internal timestamp has the legal status of a Qualified Electronic Timestamp.

YOU™ may update this Disclaimer where necessary because of:

  • changes in law;
  • regulatory guidance;
  • new technology;
  • new registration procedures;
  • new qualified trust services;
  • new NFC functionality;
  • changes in professional services;
  • or changes to YOU™ functionality.

The latest revision date will be displayed at the top.

Material changes do not retrospectively alter historical technical or evidentiary facts recorded in an existing Registration Record.

A cryptographic hash can support data-integrity evidence. It does not establish copyright ownership.

A Qualified Electronic Timestamp has a specific legal effect concerning date/time and integrity of bound data. It does not establish authorship.

A YOU™ activity log may be tamper-evident. It is not automatically a Qualified Electronic Timestamp.

YOU™ Verified means that the registration has completed the applicable YOU™ review and verification process. It is not a government or judicial authentication of the Work.

Review can detect inconsistencies. It cannot guarantee that every fraud or prior Work will be discovered.

QR and NFC technologies strengthen verification. They cannot make physical fraud impossible.

Ownership of a physical Work and copyright ownership are separate.

A Certificate does not guarantee market value, resale or investment return.

General legal information is not individual legal advice.

Legal representation requires a separate agreement with the relevant lawyer or law firm.

Mandatory consumer and other statutory rights remain unaffected.
